004.01.20 Ark. Code R. § 005 - Offender Substance Abuse

I. AUTHORITY. The Board of Corrections is vested with the authority to promulgate this administrative rule by Arkansas Code sections 12-27-105, 16-93-1203 and 16-93-1205.

II. APPLICABILITY. This rule applies to Arkansas Community Correction employees who conduct or assist in conducting substance abuse testing of offenders.

III. POLICY. Arkansas Community Correction policy is to administer a program of testing offenders for substance abuse for the purpose of enforcing conditions or lawful orders set forth by courts and the Parole Board. Appropriate confidentiality of information will be maintained.
