This rule is promulgated pursuant to section
26.5-4-204(4)(a)(I) and
(II), C.R.S.
A. Low-Income Requirements
To be considered low-income for the purposes of this rule
section, a child's parent or guardian's gross monthly income must not exceed
270% of the Federal Poverty Guideline (FPG):

B.
Qualifying Factors
The following qualifying factors will be used to determine a
child's eligibility for preschool services pursuant to this rule
section:
1. Child is identified as in
poverty if the child's parent or guardian's gross income does not exceed 100%
of the Federal Poverty Guideline (FPG).
2. Child is a dual-language learner and the
native language spoken in the child's home is a language other than English, or
the child's native language is not English.
3. Child has an IEP.
4. Child is currently in the custody of a
state supervised and county administered foster care home or in non-certified
kinship care.
5. Child is identified
as homeless and/or unhoused, and lacks a fixed, regular, and adequate nighttime
residence and at least one (1) of the following:
a. Sharing the housing of other persons due
to loss of housing; economic hardship, or a similar reason; living in motels,
hotels, or camping grounds due to the lack of alternative accommodations; or
living in emergency or transitional shelters;
b. Has a primary nighttime residence that is
a public or private place not designed for or ordinarily used as a regular
sleeping accommodation for human beings;
c. Living in cars, parks, public spaces,
abandoned buildings, substandard housing, bus or train stations, or in similar
settings; or
d. Is a child who is
migratory who qualifies as homeless for the purposes of this rule subsection
because the child is living in circumstances described in this rule subsections
(a) through (c), above.
