Conn. Agencies Regs. § 22a-209-12 - Violations
(a) No person shall violate or cause the
violation of any applicable statutes or regulations.
(b)
Remedies for violations.
(1) The Commissioner shall designate
employees of the Department who shall, acting with or without complaints,
conduct investigations and ascertain whether the solid waste management
statutes and regulations are being complied with.
(2) Whenever these employees determine that
any applicable statute or regulation has not been complied with, the
Commissioner shall send to the person or persons responsible for the
noncompliance a written order specifying the nature of the noncompliance and
affording a reasonable period of time for its correction. Nothing herein shall
be construed to limit the rights of the Commissioner to proceed with any other
remedies that he or she may deem necessary.
(3) Unless the person or persons on whom an
order has been served requests a hearing within thirty (30) days of the date of
issuance in accordance with section
22a-6c of the General
Statutes as amended, such order shall become final and effective. If a hearing
is requested, it shall be held in accordance with the Uniform Administrative
Procedure Act, Chapter 54 of the General Statutes, and the Department 's Rules
of Practice.
