Conn. Agencies Regs. § 5-273-60 - Continuation, adjournment or postponement of hearings; notice of withdrawal
(a) In the discretion of the
Board, the hearing may be continued from day to day or adjourned to a later
date, or to a different place, by announcement thereof at the hearing by the
Board or by other appropriate notice designated by the Board.
(b) Where the Board has scheduled an initial
hearing, a party may within ten (10) days of receipt of the hearing notice
request one postponement per case by:
(1)
Obtaining from the opposing party an agreement for the postponement,
(2) confirming a new mutually acceptable
hearing date, and
(3) notifying the
Board of the agreement to postpone and the new mutually acceptable hearing
date. Unless the parties have agreed on a postponement and a new hearing date
and have so notified the Board within ten (10) days, the request for
postponement shall be granted by the Board only where the requesting party or
parties have demonstrated to the Board that there is sufficient cause for such
postponement.
(c) A
party seeking to withdraw a complaint or Petition filed under the Act shall
notify the Board not later than forty-eight (48) hours prior to the scheduled
start time of a hearing on such complaint or Petition. If no such notice is
given by the party seeking to withdraw such complaint or Petition, the party
shall appear at the scheduled hearing and withdraw the complaint or Petition on
the record.
