3 Del. Admin. Code § 805-2.0 - Purpose
2.1 The passage of
the federal Agriculture Improvement Act of 2018 and legalization of
Cannabis sativa L. offers an economic opportunity for the
State of Delaware and its producers, processors, handlers, and consumers. The
purpose of these regulations is to establish appropriate standards,
definitions, and requirements for the agricultural production of hemp in the
State of Delaware.
2.2 To establish
a Hemp Production Program in the State of Delaware, the following regulations
define how the Department will comply with USDA requirements as indicated in 7
CFR Part 990 Domestic Hemp Program, as the regulatory entity of hemp production
in the State of Delaware. This administrative regulation establishes procedures
and requirements for licensing persons who wish to grow or cultivate hemp as a
participant in the Delaware Hemp Production Program.
