Fla. Admin. Code Ann. R. 60Y-10.004 - Investigatory Process
(1) Within five (5)
days of a complaint being filed, the Commission shall by registered mail send a
copy of the complaint to the establishment that allegedly committed the
violation. A copy of Section 760.11, F.S. (1992 Supp.), may also be provided in
the mail.
(2) The Commission may
likewise provide a copy of the complaint to any other agency of the state, or
to an agency of any other unit of government of the state, which has
jurisdiction of the subject matter of the complaint or which has legal
authority to investigate the complaint.
(3) Within 25 days of the date the complaint
was filed, an answer may be filed on behalf of the establishment named for the
alleged violation. The absence of an answer, however, shall in no manner delay
the investigation of the complaint.
(4) The Executive Director is authorized to
refer complaints in accordance with the provisions of Section 760.11(2), F.S.
(1992 Supp.).
