Ga. Comp. R. & Regs. R. 300-9-1-.04 - Determination of Prevailing Wage for Work of a Similar Nature in the Locality in Which the Work is to Be Performed

(1) Pursuant to the provisions of O.C.G.A. 42-5-120et seq. of the "Working Against Recidivism Act," the Georgia Department of Labor shall provide information to the Georgia Department of Corrections to assist the Department of Corrections in ensuring the payment of wages to inmates at a rate not less than that paid for work of a similar nature in the locality in which the work is to be performed.
(a) Prior to the date of the need for inmate labor as a part of the Prison Industry Enhancement Certification Program, the Department of Corrections shall file a request for a prevailing wage determination regarding all jobs and/or job classifications to be included in the proposed PIECP work project.
(b) The Department of Corrections shall submit the Prevailing Wage Request Form (DOL-1687), completed in its entirety, which shall include the following:
1. for each job and/or job classification, including information pertaining to the job title;
2. a detailed description of duties;
3. necessary job skills;
4. special tools or equipment utilized in the jobs;
5. the geographical location of the work project; and
6. the proposed wage.
(2) The Department of Labor shall review the prevailing wage determination request and determine, utilizing data collected in accordance with U.S. Department of Labor's Bureau of Labor Statistics guidelines, whether the proposed wage meets the prevailing wage rate for the geographic area, for work of a similar nature.
(3) If the wage proposed by the Department of Corrections is below the established prevailing wage for work of a similar nature in the locality in which the work is to be performed, the Department of Labor will so notify the Department of Corrections and recommend an appropriate wage range.
