Idaho Admin. Code r. 16.03.05.108 - AABD ELIGIBILITY IN INELIGIBLE INSTITUTIONS

First Month in Institution.
An AABD participant can get AABD cash for the month he entered the institution.
Eligibility for the entry month applies to these residents: (3-17-22)
a. Resident of a public institution. The
person is a resident if he or anyone pays for his food, shelter, and other
services in the institution. (3-17-22)
b. Patient in a medical institution. A
patient is a person receiving room, board, and professional services in a
medical institution, including an institution for tuberculosis or mental
diseases. (3-17-22)
02.
Temporary Institution Stay. An AABD participant can get up to
three (3) months' AABD payment during a temporary stay in an institution. A
participant entering a public medical or psychiatric institution, a hospital, a
nursing facility, or an ICF/IID may continue to get AABD payments. The
Department must receive the temporary stay data no later than the ninetieth
full day of confinement, or the release date, whichever is first. The payments
may continue up to three (3) months if these conditions are met: (3-17-22)
a. The Department is informed of the
institutional stay. (3-17-22)
b. A
physician certifies the participant 's stay is not likely to exceed three (3)
full months. (3-17-22)
c. A signed
statement from the participant or a responsible party showing the participant 's
need to continue to maintain and pay for the place he intends to return to
live. (3-17-22)
