The Director may declare a hazardous waste emergency if the
public health, safety or the environment are threatened by a release or threat
of release of a hazardous waste or a substance which has become a hazardous
waste. Following a hazardous waste emergency declaration, the Department may
spend or obligate to be spent up to two hundred thousand dollars ($200,000)
from the Hazardous Waste Emergency Account, Section
39-4417, Idaho Code, to obtain
equipment and materials, conduct investigations, test samples, and employ
personnel as necessary or eliminate or mitigate the immediate threat and
stabilize the situation. The Director may authorize the expenditure or
obligation of more than two hundred thousand dollars ($200,000) from this
account in any given situation upon a finding by the Board that a greater
expenditure or obligation is prudent and necessary to protect the public
health, safety or environment. (3-24-22)
