Financial
Assurance Required. The permittee is required to provide financial
assurance pursuant to the Idaho Mined Land Reclamation Act, Chapter 15, Title
47, Idaho Code, and the rules promulgated thereunder. The Department will not
issue a permit under these rules to a cyanidation facility unless a permanent
closure plan for the cyanidation facility has been submitted for approval under
Chapter 15, Title 47, Idaho Code. Any permit issued under these rules will
prohibit construction and operation of the cyanidation facility until the
permittee submits proof acceptable to the Department that financial assurance
for the cyanidation facility permanent closure plan has been provided as
required by Chapter 15, Title 47, Idaho Code. (3-24-22)
02.
Insufficiency. In the event
the financial assurance is forfeited as described in the Idaho Mined Land
Reclamation Act, Chapter 15, Title 47, Idaho Code, the Department may seek to
recover the amount necessary to implement permanent closure under the
Department-issued permit and these rules as provided by law.
