Purpose. The purpose of Sections
002 through
730 is to provide procedures for
contested cases as required under Idaho Code ยง
39-107. (3-31-22)
02.
Applicability. Any person
aggrieved by an action or inaction of the Department may file a petition to
initiate a contested case pursuant to Chapter 52, Title 67, Idaho Code. These
rules govern such proceedings, except that Idaho Pollutant Discharge
Elimination System permit decisions are governed by IDAPA 58.01.25, "Rules
Regulating the Idaho Pollutant Discharge Elimination System Program," Section
204. (3-31-22)
