Ill. Admin. Code tit. 32, § 130.40 - Project Eligibility Requirements

In order to be eligible for funding under the program, the proposed project must meet all of the following criteria:
a) the project must be physically located in
the State of Illinois;
b) the
project must be either a plant construction project or a plant expansion
project; new construction must consist of 30 million gallons or more;
c) the owner must commit to entering into a
Project Labor Agreement covering the project that is compliant with the
provisions of Section
130.60;
d) the owner must commit to securing all
financing (debt and equity) necessary to complete the project; and
e) The owner must commit to using Illinois
agricultural products as the primary source in the renewable fuels production
process.
