Ill. Admin. Code tit. 35, § 728.132 - Waste-Specific Prohibitions: Soils Exhibiting the Toxicity Characteristic for Metals and Containing PCBs
a)
The following wastes are prohibited from land disposal : any volumes of soil
exhibiting the toxicity characteristic solely because of the presence of metals
(USEPA hazardous waste numbers D004 through D011) and containing
PCBs.
b) The requirements of
subsection (a) do not apply if any of the following conditions is fulfilled:
1) Low-Halogenated Organics Waste Meeting the
Treatment Standards of Subpart D
A) The
wastes contain halogenated organic compounds in total concentration less than
1,000 mg/kg; and
B) The wastes meet
the treatment standards specified in Subpart D for USEPA hazardous waste
numbers D004 through D011, as applicable; or
2) Low-Halogenated Organics Waste Meeting
Alternative Treatment Standards for Contaminated Soil
A) The wastes contain halogenated organic
compounds in total concentration less than 1,000 mg/kg; and
B) The wastes meet the alternative treatment
standards specified in Section
728.149
for contaminated soil ; or
3) A person has been granted an exemption
from a prohibition pursuant to a petition under Section
728.106,
with respect to those wastes and units covered by the petition; or
4) The wastes meet applicable alternative
treatment standards established pursuant to a petition granted under Section
728.144.
