Ill. Admin. Code tit. 77, § 693.35 - Fines and Penalties
a) The
Department, after notice and an opportunity for a hearing, may fine any health
care professional, laboratory or blood bank that violates Section
693.30 of this Part or Section 4
of the Act. The fine shall be $500 for each violation. Based upon the evidence
presented at the hearing, fines shall be imposed based upon malicious intent,
negligence and incompetence. Following service of a Notice of Violation by the
Department, the respondent health care professional, laboratory or blood bank
shall have 10 business days in which to request a hearing. All proceedings
under this subsection shall be governed by the Department's Practice and
Procedure in Administrative Hearings.
b) The Department shall report each violation
of Section 4 of the Act or Section
693.30 of this Part to the
regulatory agency responsible for licensing a health care professional or a
laboratory to which these provisions apply. (Section 4(d) of the Act)
