312 IAC 29-19-4 - Notice to affected owners and informal hearing

Sec. 4.
(a) Upon
receipt of a complete petition for involuntary integration, the division
director shall schedule an informal hearing to be conducted according to the
requirements of
312 IAC 29-3-4. The informal
hearing shall be for the purpose of gathering information to assist the
division director in establishing reasonable terms that provide for the
equitable sharing of the proceeds of production from the well or
unit.
(b) In addition to the
requirements of
312 IAC 29-3-4(d)
the notice of the informal hearing shall:
(1) be provided to the petitioner and each
owner or lessee identified in the petition;
(2) provide notification of the right to
attend the informal hearing and to submit comments on or objections to the
petition; and
(3) provide
notification of the requirement that each nonconsenting owner or lessee respond
to the division, and serve upon the petitioner, at least five (5) days prior to
the informal hearing a statement indicating their willingness to participate
with the consenting owners in the sharing of costs for drilling and operating
the well and unit.
