327 IAC 5-19-1 - POTWs required to have a pretreatment program

Sec. 1.
(a) A POTW,
or a combination of POTWs operated by the same authority, that meets at least
one (1) of the following conditions must establish a POTW pretreatment program:
(1) Has a total design flow greater than five
(5) million gallons per day (mgd) and receives pollutants, from one (1) or more
industrial users, that may pass through or interfere with the operation of the
POTW.
(2) Receives flow subject to
pretreatment standards or requirements under 327 IAC 5-18.
(b) A POTW with a design flow of five (5) mgd
or less may also be required to develop a POTW pretreatment program if the
commissioner determines that a pretreatment program to prevent interference or
pass through at the POTW is warranted due to the nature or volume of one (1) or
more of the following:
(1) Industrial
influent.
(2) Treatment process
upset.
(3) Violations of POTW
effluent limitations.
(4)
Contamination of municipal sludge.
(5) Other circumstances.
(c) A POTW desiring to modify categorical
pretreatment standards under 327 IAC 5-20 must have an approved POTW
pretreatment program.
