Sec. 1.
(a) An
individual is an individual with a significant disability if an individual:
(1) meets the requirements set forth in
34 CFR
361.5(b)(31); or
(2) has been determined eligible for Social
Security benefits under Title II or Title XVI of the Social Security Act
according to 34 CFR
361.42(a)(3).
(b) An individual is an individual
with a most significant disability if an individual with a significant
disability, as described in subsection (a), meets the following additional
requirements:
(1) Has a severe physical or
mental impairment that seriously limits three (3) or more functional capacities
in terms of an employment outcome.
(2) Requires multiple vocational
rehabilitation services over an extended period of time.
(3) Has one (1) or more physical or mental
disabilities determined to cause comparable substantial functional limitation.
