560 IAC 2-3.1-5 - Hearing

Sec. 5.
(a) The
hearing examiner shall conduct a hearing to take evidence on the
complaint.
(b) The hearing shall be
conducted in accordance with IC 4-21.5-3 and this rule.
(c) Parties shall present evidence and may
cross-examine witnesses.
(d) All
testimony shall be taken under oath.
(e) The hearing examiner shall issue a
recommended order within ninety (90) days of the later of:
(1) the conclusion of the hearing;
or
(2) submission of post-hearing
briefs or proposed findings of fact and conclusions of law.
(f) The hearing examiner's
recommended order shall include:
(1) findings
of fact;
(2) conclusions of law;
and
(3) recommended remedy, if
applicable.
