Kan. Admin. Regs. § 100-76-10 - Release of records
(a) Each
licensed acupuncturist shall, upon receipt of a signed release from a patient,
furnish a copy of the patient record to the patient, to another licensee
designated by the patient, or to the patient's legally designated
representative, unless withholding records is permitted by law or furnishing
records is prohibited by law.
(b)
Any licensee may charge a person or entity for the reasonable costs to retrieve
or reproduce a patient record. A licensee shall not condition the furnishing of
a patient record to another licensee upon prepayment of these costs.
(c) Each violation of this regulation shall
constitute prima facie evidence of unprofessional conduct pursuant to K.S.A.
2017 Supp.
65-7616, and amendments
thereto.
