Kan. Admin. Regs. § 5-13-11 - Time to perfect a water right for evaporation of groundwater
(a) A reasonable
time to perfect a water right for evaporation of groundwater caused by a sand
and gravel pit operation shall be neither less than five calendar years plus
the remainder of the calendar year in which the application was approved, nor
more than 20 years plus the remainder of the calendar year in which the
application was approved.
(b)
(1) For good cause shown by the applicant, a
reasonable extension of the time to perfect the water right shall be allowed by
the chief engineer if both of the following conditions are met:
(A) The request is timely filed pursuant to
the terms of K.A.R. 5-3-7.
(B) The
request is accompanied by the statutorily required filing fee.
(2) The total time to perfect a
water right shall not exceed 40 years.
