The hearing officer, within one (1) month after the conclusion
of the hearing, shall submit his or her report to the state board. The state
board shall take action at its next regular meeting following receipt of the
report unless continued to its next regular meeting. Failure of six (6) or more
members to approve the appeal shall constitute a denial of the appeal. If the
appeal relates to out-district tuition and is sustained by the state board, the
decision shall fix the amount of tuition to be paid by the local board.
Determination of any appeal by the state board shall be final and conclusive.
The state board's decision shall be in writing, signed, and certified by the
commissioner of education, and mailed or personally delivered to all interested
parties no later than five (5) days after the adjournment of the meeting in
which it is made. If mailed, the decision shall be sent by certified or
restricted mail with return receipt requested. If delivered, an acknowledgement
of receipt shall be taken from the interested party. Upon receipt of the
decision of the state board approving the application of the appellant, the
local board denying appellant's application shall immediately comply with the
decision.
