La. Admin. Code tit. 33, § III-101 - Authority
A. By virtue of
R.S.
30:2011 the Air Quality program within the
Department of Environmental Quality was established with the intent and purpose
of maintaining the purity of the air resources of the state of Louisiana
consistent with the protection of the health and physical property of the
people, maximum employment and the full industrial development of the state.
R.S.
30:2011 sets forth the powers of this
administrative authority and by
R.S.
30:2019 authorizes the promulgation by this
administrative authority of rules and regulations consistent with said intent
and purpose in the manner and in accordance with the provisions of
R.S.
30:2001 et seq., which was enacted by the
legislature as the law of this state by Act 449 of 1979.
B. The administrative authority has been
authorized by the Louisiana Department of Environmental Quality to provide and
administer these regulations under
R.S.
30:2011 and in accordance with the provisions
of
R.S.
30:2001 et seq., of Title 30 enacted by the
state legislature as the law of this state by Act 449 of 1979 and amended by
Act 97 of 1983.
C. Matter
Incorporated by Reference. Incorporated by reference in these regulations is
all matter of material that is not specifically set forth herein. These
materials are hereby made a part of these regulations. Unless the reference
indicates otherwise, materials subject to change are incorporated only as they
are in effect on the date of promulgation of the regulation.
