La. Admin. Code tit. 46, § LXIII-1905 - Petitions to the Board
A. In
accordance with the provisions of Title 49 Section 953C (1), any interested
person may petition an agency to request the adoption, amendment, or repeal of
a rule. This section sets forth the board's procedure for their submission,
considerations, and disposition.

Procedures for Submission. The board shall consider any petition that is
signed, dated, and received by the board via USPS certified mail on the form
specified by the board.
2. The form
shall require the name and contact information of the petitioner; reference to
the specific statutory or regulatory provision the petitioner is seeking to
change; reason(s) for the request; the petitioner's personal interest in the
requested change; and/or the petitioner's professional interest in the
requested change.
B.
Disposition
1. Upon receiving a petition, the
agency shall acknowledge its receipt and docket the petition for review at the
next regularly scheduled board meeting.
2. The board shall provide a response to the
petition within 90 days of submission. The board's response will include its
determination to either deny the petition, stating reasons in writing for the
denial, or notify the petitioner of its intent to initiate rulemaking
proceedings.
