La. Admin. Code tit. 55, § I-2321 - Recovery of Civil Penalties
A.
To enforce the collection of a civil penalty levied upon a person determined by
the deputy secretary of the Department of Public Safety and Corrections to have
committed an act that is a violation of these regulations, the deputy
secretary:
1. may order the removal of the
offending vehicle 's license tag if the registration is from this
state;
2. may seize any vehicle not
registered within the state which is owned by the person or company in
violation;
3. shall have the
driver's or operator's license suspended for a violation(s) committed by the
driver or operator.
B.
The secretary shall enforce the provisions of Subsection A as follows.
1. The removal of a vehicle 's license tag
shall be completed and, upon remittance of the levied penalty, reinstated in a
manner consistent with the procedures required by the Office of Motor
Vehicles.
2. When the person or
company fails to remit a levied civil penalty within 90 days subsequent to the
seizure of a vehicle as authorized in this Section, the Department of Public
Safety and Correction shall collect the penalty in a manner consistent with
applicable portions of
R.S. 32:521
et seq.
3. The suspension of a
driver's license shall be completed and, upon remittance of the levied penalty,
reinstated in a manner consistent with the provisions required by the Office of
Motor Vehicles.
