01-026 C.M.R. ch. 70, § 4 - Notice of Right to Hearing

A. Upon receipt of
an application or otherwise when the Board's action is covered by these rules,
the Board shall give notice to:
1. The person
or persons whose legal rights, duties or privileges are at issue, by regular
mail, sufficiently in advance of the anticipated time of the decision to afford
an adequate opportunity to prepare and submit evidence and argument, and to
request a hearing if so desired; and
2. The general public, in any proceeding
deemed by the Board to involve the determination of issues of substantial
public interest, such notice to be given sufficiently in advance of the
anticipated time of the decision to afford interested persons an adequate
opportunity to prepare and submit evidence and argument, and to request a
hearing if so desired.
B. This section is complied with if notice is
given as provided in 6 of these regulations.
