Definitions

The following terms, as used in this Chapter, have the following meanings:

A. Administering Entity. "Administering Entity" means a third party selected by the Department to administer a wood stove replacement and rebate program using monies from the fund consistent with the criteria set forth in this Chapter.

B. ANSI. "ANSI" means the American National Standards Institute.The American National Standards Institute (ANSI) provides accreditation in accordance with ISO/IEC Guide 65 for product certification programs.

C. EPA certified residential wood heater. "EPA certified residential wood heater" means a wood stove manufactured after 1988 that has been certified by EPA at 40 CFR Part 60, Subpart AAA as were in effect on the date of the adoption of this Chapter.

D. Fund. "Fund" means a non-lapsing fund established by 38 M.R.S.A. §610-D. The fund will be administered by the Commissioner to be used by the Department for providing financial incentives for the replacement of uncertified wood stoves with residential heating appliances that have lower emissions of pollution and to pay for the administration of the replacement and rebate program if administered by an administering entity.

E. Participating dealer. "Participating dealer" means a heating appliance dealer who agrees to a Department memorandum of agreement to accept vouchers toward the purchase of qualifying replacement heating appliances, install the new replacement heating appliance, and remove the old uncertified wood stove pursuant to requirements of this Chapter.

F. Primary household heating appliance. "Primary household heating appliance" means a heating appliance that provides more than 50% of the heat for a residence that is occupied for more than 50% of the year.

G. Primary Residence. "Primary Residence" means a person's homestead as defined in 36 M.R.S.A. §6201(5).
