A.
Recission of Storm Water Management
Law and Site Location of Development Law Permits. The Commissioner will
rescind a license upon petition of the licensee, provided the conditions set
forth in 38 M.R.S.
§420-D(14) (Storm Water
Management Law) or
38 M.R.S.
§489-C (Site Location of Development
Law) are met. If a recission is approved for a permit previously recorded in
the registry of deeds, the petition and the written approval must be recorded
in the registry of deeds by the licensee.
B.
Surrender. Any licensee may
petition the Commissioner to surrender its license. At the Commissioner's
discretion, the petition may be granted provided no outstanding license
violation exists. The petition must state that the licensee waives notice and
the opportunity for a hearing. In addition, an agronomic utilization license
may be surrendered at any time in accordance with 38 M.R.S. §
1310-N(6-D).
