A.
Applications. Application for
an interim license for a waste facility for hazardous waste must be made by
filing the form provided by the Department within 45 days of the effective date
of rules of the Board in which a waste handled in the facility is identified as
hazardous. An application is "filed" on the date as of which it is determined
by the Department to be complete, consistent with this Chapter and
Rules Concerning the Processing of Applications and Other
Administrative Matters, 06-096 C.M.R. ch. 2.
B.
Issuance. Interim licenses
will be issued or deemed to have been issued by the date of the second regular
meeting of the Board of Environmental Protection to occur after an application
is complete, unless non-issuance is due to delay ascribed to the
applicant.
