SUMMARY: These regulations describe the scope of review of the Department in determining a developer's compliance with the "no adverse effect on the natural environment" standard of the Site Location Law ( 38 M.R.S.A. Section484(3)); the information which shall be submitted, when appropriate, within an application for approval; and, the terms and conditions which the Department may impose on the approval of an application to ensure compliance with the standard.
NOTE: In determining whether the developer has made adequate provision for fitting the development harmoniously into the existing natural environment and that the development will not adversely affect existing uses, scenic character, or natural resources in the municipality or in neighboring municipalities, the Department has identified several specific areas of concern which are dealt with in detail below.
