Md. Code Regs. 08.03.04.11 - Hunting Wild Turkeys and Black Bear Over Bait
A. Definitions.
(1) "Baited area" means any area where shelled,
shucked, or unshucked corn, wheat, other grain, or other feed capable of luring,
attracting, or enticing wild turkeys or black bears is directly or indirectly
placed, exposed, deposited, distributed, or scattered. An area is considered a
baited area for 10 days following complete removal of all corn, wheat, other grain,
or other feed.
(2) "Baiting" means the
placing, exposing, depositing, distributing, or scattering of shelled, shucked, or
unshucked corn, wheat, other grain, or other feed so as to constitute for wild
turkeys or black bears a lure, attraction, or enticement to, on, or over any areas
where hunters are attempting to take wild turkeys or black bears.
B. A person may not take or attempt to
take wild turkeys or black bears by the aid of baiting, or on or over any baited
area if the person knows or reasonably should know that the area is a baited area.
C. This regulation does not prohibit
the taking of wild turkeys or black bears on or over:
(1) (text unchanged)
(2) Lands where shelled, shucked, or unshucked
corn, wheat, other grain, or other feed has been distributed or scattered as the
result of bona fide agricultural operations or procedures, or as a result of
manipulation of a crop or other feed on the land where grown for wildlife management
purposes. Manipulation of crops or other feed for wildlife management purposes does
not include the distributing or scattering of grain or other feed once it has been
removed from or stored on the field where grown.
(3) Lands where a person is hunting black bear
during the black bear season provided that the person and any black bear that the
person shoots at is 150 yards or more from an area where grain or other feed has
been legally placed for the purpose of attracting wildlife other than black
bears.
(4) Lands where a person is
hunting wild turkeys during the fall season provided that the person and any wild
turkey that the person shoots at is 150 yards or more from an area where grain or
other feed has been legally placed for the purpose of attracting wildlife other than
wild turkeys.
