A. Procedure for
Hearings.
(1) Within 10 days after receiving
a request for a hearing, the Council shall request that the Office of
Administrative Hearings designate an administrative law judge.
(2) The administrative law judge shall give
reasonable notice of the hearing by certified mail, return receipt requested,
to the sponsor.
(3) The notice
shall include a:
(a) Reasonable time and
place of hearing;
(b) Statement of
the provisions of this chapter pursuant to which the hearing is to be held;
and
(c) Concise statement of the
matters pursuant to which the action forming the basis of the hearing is
proposed to be taken.
B. The administrative law judge shall
regulate the course of the hearing. Hearings shall be informally conducted.
Every party shall have the right to counsel, and a fair opportunity to present
his or her case including such cross-examination as may be appropriate in the
circumstances. The administrative law judge shall make proposed findings and
recommended decisions to the Council upon the basis of the record.
