Md. Code Regs. 11.02.08.02 - Definitions
A. In this chapter,
the following terms have the meanings indicated.
B. Terms Defined.
(1) "Conviction" means:
(a) A judgment of conviction, whether entered
upon a finding of guilt or acceptance of a plea of nolo contendere, and the
imposition of sentence; or
(b) The
staying of the entry of judgment and the placing of the defendant on probation
after a finding of guilty or the acceptance of a plea of nolo
contendere.
(2) "Day" or
"Days" means a calendar day or calendar days.
(3) "Designated representative" means an
attorney, an employee organization representative, or any other individual
authorized in writing by a party to represent the party.
(4) "Nondisciplinary administrative
termination" means termination of a police officer of the Department for
reasons not covered by the Law Enforcement Officers' Bill of Rights, including
termination because of a physical or mental impairment which prevents the
performance of essential functions of the job, with or without reasonable
accommodations.
(5) "Party" means
an employee or a group of employees having a grievance or other right of appeal
or the Maryland Department of Transportation.
(6) "Work days" means all days except
Saturdays, Sundays, and observed holidays.
(7) "Working days" means all days except
Saturdays, Sundays, observed holidays, and all days an employee is on
leave.
