Md. Code Regs. 14.02.06.06 - Return or Destruction of Confidential Records or Information
A. No Appeal of
Board Decision Filed.
(1) After 45 days from
the issuance of the Board's decision, the Board shall notify the custodian to
make appropriate arrangements for the return of all records or information
received by the Board pursuant to COMAR 14.02.05.03.
(2) Destruction of Records or Information.
(a) If a custodian fails to make arrangements
for the return of records or information received by the Board pursuant to
COMAR 14.02.05.03, the Board shall
destroy the records or information after 90 days from the issuance of the
Board's decision.
(b) Destruction
of electronic records or information shall be accomplished by deleting the
records or information from email and the internal network drive of the Public
Access Unit.
(c) Destruction of
hardcopy records or information shall be accomplished by shredding the
records.
B.
Appeal of Board Decision Filed.
(1) The Board
shall continue to store records or information received by the Board pursuant
to COMAR 14.02.05.03 according to
Regulation .03 of this chapter.
(2)
Once the opinion of the circuit court has issued, the Board shall return or
destroy the records or information received by the Board pursuant to COMAR
14.02.05.03 according to the time
periods provided in §A of this regulation.
