Md. Code Regs. 26.11.03.09 - Review by EPA of Part 70 Permits
A. The Department shall provide the EPA with
a copy of each application for a Part 70 permit, including an application for a
permit revision, each proposed permit, and each final Part 70 permit, unless
the EPA agrees to accept a summary of the application and related information.
The Department may require the applicant to submit a copy of the permit
application, including the compliance plan directly to the EPA.
B. Except for administrative permit
amendments for which notice to the EPA is not required, the Department may not
issue or revise the federally enforceable provisions of a Part 70 permit if the
EPA:
(1) Objects to its issuance or revision
in writing within 45 days of EPA's receipt of the proposed permit or revision
and any necessary supporting information; and
(2) Specifies the basis for its objection and
a description of the terms and conditions that must be included in the permit
to respond to the objection.
