Md. Code Regs. 26.11.03.09 - Review by EPA of Part 70 Permits
A. The Department shall provide the EPA with a copy of each application for a Part 70 permit , including an application for a permit revision, each proposed permit , and each final Part 70 permit , unless the EPA agrees to accept a summary of the application and related information. The Department may require the applicant to submit a copy of the permit application , including the compliance plan directly to the EPA .
B. Except for administrative permit amendments for which notice to the EPA is not required, the Department may not issue or revise the federally enforceable provisions of a Part 70 permit if the EPA :
(1) Objects to its issuance or revision in writing within 45 days of EPA 's receipt of the proposed permit or revision and any necessary supporting information; and
(2) Specifies the basis for its objection and a description of the terms and conditions that must be included in the permit to respond to the objection.
