Md. Code Regs. 26.11.03.22 - Part 70 Permits for Temporary Sources
A. A temporary source is a Part 70 source
that the applicant intends to relocate from one site to another site at least
once during the term of the permit. The owner or operator of a temporary source
that is required to obtain a Part 70 permit, under Regulation .01 of this
chapter, shall apply for the Part 70 permit in accordance with the requirements
of this chapter.
B. The Department
may issue a single Part 70 permit that authorizes operation of a temporary
source at multiple sites.
C. The
Department may not issue a permit as a temporary source to an affected source
under the acid rain program.
D.
Part 70 permits for temporary sources shall include:
(1) Conditions to assure compliance with all
applicable requirements of the Clean Air Act at all authorized sites;
(2) A requirement that the owner or operator
notify the Department at least 10 days in advance of each change in
site;
(3) State-only enforceable
conditions that assure compliance with all other applicable requirements of the
State air pollution control law; and
(4) Conditions that assure compliance with
all other provisions of this regulation.
E. The owner or operator of a temporary
source shall create and maintain records of the duration of its stay at a site,
in addition to the other records required under this subtitle.
