105 CMR, § 158.005 - Requirement for a License
(A) No person shall
establish or maintain a Program without having obtained an original license
from the Department, except in accordance with 105 CMR 158.005(B).
(B) A Program operating prior to January 2,
2015 shall:
(1) Submit an application for an
original license in accordance with 105 CMR 158.000 on or before May 1, 2015;
and
(2) Comply with all
requirements of 105 CMR 158.000 on or before May 1, 2015, except:
(a) requirements specifically waived in
accordance with
105 CMR
158.029(B); and
(b) requirements that the Program
specifically identifies in an attestation filed in accordance with 105 CMR
158.005(D).
(C) An application for an original license
for a Program operating prior to January 2, 2015 shall have the effect of a
license until such time as the Department takes action on the
application.
(D) A Program
operating prior to January 2, 2015 shall submit an attestation of compliance to
the Department on or before May 1, 2015, as specified in guidelines of the
Department. The attestation shall identify the Program's areas of compliance
and areas of non-compliance and shall describe the Program's plan of action to
achieve full compliance by one year after January 2, 2015 or to seek waivers in
accordance with
105 CMR 158.029(B)
by one year after January 2, 2015.
(E) A license shall pertain to only one
Program site. Licensees or applicants that wish to operate, or operate more
than one Program or program site shall apply for and obtain a separate license
for each.
