105 CMR, § 410.833 - Service of Orders
(A) All orders
issued under
105 CMR 410.830
shall be served on the persons responsible for the violation. Orders and/or
notices issued under
105
CMR 410.831 shall be served on the owner or
his agent and the affected occupants.
(B) All orders and/or notices shall be
served:
(1) personally by an person authorized
to serve civil process; or
(2) by
leaving a copy at his last and usual place of abode; or
(3) by sending him a copy by registered or
certified mail, return receipt requested if he is within the Commonwealth;
or
(4) if his last and usual place
of abode is unknown or outside the Commonwealth, by posting a copy in a
conspicuous place on or about the dwelling or portion thereby
affected.
(C) A copy of
every order issued under the provisions of
105
CMR 410.831 shall also be served upon every
mortgagee and lien holder of record by sending it registered or certified mail,
return receipt requested.
(D) A
copy of every order or subsequent notice issued under the provisions of
105 CMR 410.830
to an owner shall also be personally delivered or sent by first class mail to
the occupants of all affected premises, except that when a violation in a
common area affects more than three dwelling units or rooming units the
notification required by 105 CMR 410.000 may be satisfied by posting a copy of
every order or subsequent notice in a conspicuous place in the
building.
