211 CMR 41.20 - Briefs

(1) Parties shall
file briefs within a period set by the Presiding Officer. Parties shall file
five copies of briefs and serve one copy on each Party, unless the Presiding
Officer directs that a different number of copies be provided. The Presiding
Officer may set a page limit for briefs and may require Parties to file a copy
of briefs by electronic means in a format determined by the Presiding Officer.
Each brief shall include:
(a) A concise
statement of the case;
(b) A clear
and specific identification of all evidence relied upon by the filing Party,
with references to the pages in the record where the evidence
appears;
(c) Arguments and
supporting authorities;
(d) A
statement of the specific relief requested on each contested issue;
and
(e) Any other information
required by the Presiding Officer.
(2) Parties may submit reply briefs at the
discretion of the Presiding Officer, within a period set by the Presiding
Officer. Reply briefs must comply with the format, filing and service
requirements of 211 CMR 41.20(1).
