310 CMR, § 36.30 - Permit Application Denials
(1)
Without limitation, the Department may deny a permit application or impose
additional conditions on a permit if it determines that:
(a) the withdrawal will not conform to the
applicable standards for permitting established by 310 CMR 36.00;
(b) the withdrawal will negatively impact any
of the factors listed in M.G.L. c. 21G or in
310 CMR
36.26;
(c) the applicant has submitted information
in the permit application which the applicant knew or reasonably should have
known was false or misleading; or
(d) the application is not complete by the
applicable date.
(2) The
Department shall deny permit applications for withdrawals from a water source
if it finds:
(a) that the combined volume of
existing, permitted and proposed withdrawals exceeds the safe yield of the
water source; or
(b) that the
existing, permitted or proposed withdrawals are otherwise in
conflict.
