310 CMR, § 40.1402 - Responsibility for Performing Public Involvement Activities in Response Actions
(1) Public
Involvement Activities required by this Contingency Plan shall be performed at
all disposal sites, regardless of whether the Department, RP, PRP or Other
Person is conducting the response action.
(2) At any disposal site where the Department
is performing a response action, the Department shall be responsible for all
Public Involvement Activities pursuant to M.G.L. c. 21E, and 310 CMR
40.0000.
(3) At any disposal site
at which a RP, PRP or Other Person is conducting a response action, that RP,
PRP or Other Person shall be responsible for all Public Involvement Activities
pursuant to M.G.L. c. 21E, and 310 CMR 40.0000.
(4) Nothing shall prohibit the Department
from conducting Public Involvement Activities at any disposal site where the
Department deems it is appropriate.
