803 CMR, § 2.16 - Required Dissemination of CORI
(1) Each employer,
volunteer organization, or governmental licensing agency shall provide a copy
of a subject's CORI or other criminal history information, and shall disclose
the source of the information, to him or her:
(a) before asking any questions about the
subject's criminal history; and
(b)
before making an adverse employment, volunteer, or licensing decision based on
the subject's CORI.
(2)
Each employer, volunteer organization, or governmental licensing agency that is
overseen, regulated, or supervised by a governmental entity shall, upon
request, disseminate CORI relating solely to the requestor's employees or
licensees to that governmental entity's staff in order for the governmental
entity to ensure that the requestor is in compliance with the governmental
entity's regulations, policies, or procedures.
