995 CMR 2.05 - Number of Commissions

(1) The
Commissioners shall, from time to time, determine if there is need for an
additional state Commissioned Pilot for District One or for any special
location within the district. The Commissioners shall request advice from the
existing Commissioned Pilots and may obtain advice and information from any
other source prior to making a determination in respect to such need.
(2) The Commissioners' decision shall be made
after consideration of the various factors pertaining to such need, which shall
include, but not be limited to, supply and demand for pilotage services, safety
and efficiency in furnishing pilotage services, and the interest of the public
and the maritime industry in having available a reasonable number of
experienced, professional and efficient Pilots.
(3) When the Commissioners decide to change
the number of commissions, they shall send to the Trustees of the Boston Marine
Society and the President of the Boston Pilots by Certified Mail (Return
Receipt Requested) a prompt notice of the change, signed by both Commissioners
and notarized.
