Mich. Admin. Code R. 340.1851 - Filing a state complaint
Rule 151.
(1) A
state complaint filed with the office of special education of the department
must meet the requirements of
34 CFR 300.153
(2019).
(2) An individual shall
file a state complaint with the office of special education of the department
within 1 year of the date of the alleged violation.
(3) The complainant shall deliver the state
complaint to the office of special education of the department and the public
agency by mail, by personal delivery, or by electronic submission.
(4) Any person acting on behalf of a
complainant shall provide evidence of that authority to the office of special
education of the department.
