Mich. Admin. Code R. 500.1512 - Complaint-resolution process; basis for director's determination; failure to supply materials or information

Rule 12.
(1) If a
review and determination is conducted through written materials, the director
shall base his or her determination upon written materials submitted by the
person making the complaint and the insurer.
(2) If a review and determination is
conducted through a meeting pursuant to
R
500.1510(4), the director shall base
his or her determination upon written materials submitted by the person making
the complaint and the insurer, any statements made at the meeting, or a
combination of both.
(3) If the
person making the complaint or the insurer fails to supply any materials or
information in a timely manner, the director shall base his or her
determination upon materials and information available to the director at the
time of the determination.

Rule 12. The commissioner shall base his or her decision upon written materials submitted by the parties and the statements of the parties at the meeting, if any. Failure of either party to supply any information in a timely manner shall result in a decision based upon information available to the commissioner at the time of the decision.
