Minn. R. agency 192, ch. 9055, pt. 9055.0190 - STATE SOLDIERS' ASSISTANCE PROGRAM
A. The commissioner
must administer the state soldiers' assistance program in accordance with this
chapter and Minnesota Statutes, chapters 196 and 197.
B. An individual eligible to receive benefits
from the state soldiers' assistance program includes:
(1) a veteran;
(2) a veteran's dependent;
(3) a member of the armed forces called from
reserve status to extended federal active duty under Minnesota Statutes,
section
196.05,
subdivision 1, clause (9); and
(4)
a dependent of a member of the armed forces called from reserve status to
extended federal active duty under Minnesota Statutes, section
196.05,
subdivision 1, clause (9).
C. A surviving spouse who has remarried is
not eligible for benefits from the state soldiers' assistance program
regardless of the outcome of the subsequent marriage.
D. An individual is not eligible for benefits
from the state soldiers' assistance program if the individual is:
(1) incarcerated;
(2) civilly committed under Minnesota
Statutes, chapter 253D; or
(3)
civilly committed to an inpatient program under Minnesota Statutes, chapter
253B, for longer than 30 days.
