30 Miss. Code. R. 1001-8.3 - Notice of Formal Complaint and Disciplinary Hearing
The respondent shall be served with the Board's formal Complaint and Notice of Hearing by certified mail, return receipt requested, to the respondent's address of record with the Board, at least thirty (30) days prior to the date of the scheduled hearing.
A. The formal Complaint shall state the facts
which form the basis of the alleged violation of law or rule with reasonable
specificity to enable the respondent to defend against the same. The Notice
shall inform the respondent as to the date, time, and location of the hearing,
and shall enclose a copy of these administrative rules.
B. The respondent may respond in writing to
the allegations of the Complaint within twenty (20) days from the date of
service and may choose to be represented by counsel at the disciplinary
hearing. The answer, as well as other documents, which may be filed with the
Board related to a scheduled disciplinary proceeding shall be mailed to the
Board at Post Office Box 1884, Jackson, MS 39215-1844.
C. A motion for a continuance must be made in
writing no later than five (5) business days prior to the date of a scheduled
disciplinary hearing and may be granted by the Board.
