PURPOSE: This rule explains how a provider may request a variance from the rules of this chapter.
(1) Any provider may request a variance from
a rule. The request for a variance shall be written to the Child Care Unit and
shall include the item(s) for which a variance is requested and the reason(s)
the provider requests the variance. Local inspectors may request a variance on
behalf of the provider.
(2) If a

advised in writing of the basis for the denial. The provider may request a
review of the decision by the director within thirty (30) days of receipt. The
director or designee shall have fifteen (15) days to make the final
