8 CSR 60-2.035 - Notice of Hearing
(1) Upon
the failure of conciliation efforts, the chairperson, his/her designee or the
person designated as acting chairperson, if in his/her judgement circumstances
so warrant, may order the case set for public hearing before a panel of
commissioners or before a hearing examiner. Notice of public hearing shall be
served on all parties not less than thirty (30) days prior to the scheduled
date of hearing except as otherwise provided in
8 CSR
60-2.130. The notice of public hearing shall be
accompanied by a copy of the complaint, as it may have been amended. The notice
of public hearing and accompanying documents shall be served by certified mail
or by personal service.
(2) Proof
of service shall consist of either the verified return of the individual who
made service, which return shall set forth the manner of service. Proof of
service by certified mail shall consist of the signed return receipt from the
certified mail.
