023.01 Before instructors will be certified to teach, instructors must meet and maintain the following qualifications for certification to instruct the Handgun Training and Safety Course approved curriculum:

023.01A Be at least 21 years of age;

023.01B Not be prohibited from purchasing or possessing a handgun by 18 U.S.C. 922 as that section existed on January 1, 2005;

023.01C Possess the eyesight necessary for a Class "O" operator's license;

023.01D Not have plead guilty or nolo contendere or been convicted of a felony or crime of violence in any jurisdiction;

023.01E Not currently be adjudged mentally incompetent or have been found to be mentally ill and dangerous in the past ten (10) years.

023.01F Have had no violations of any law relating to firearms, unlawful use of a weapon, or controlled substances in Nebraska or any other jurisdiction in the past ten (10) years;

023.01G Not be on parole, probation, house arrest, or work release for any type of offense of any degree.

023.01H Be a citizen of the United States; and

023.01I Possess a valid firearms instructor certification to teach handgun courses. This can be certification either as a State of Nebraska Certified Firearms Instructor (law enforcement only), a Military Pistol Instructor, a National Rifle Association Certified Pistol Instructor, or instructor in some other program meeting the same standards for instructor certification. A notarized copy of the certificate of completion from the certifying entity shall be submitted to the Nebraska State Patrol.
