Nev. Admin. Code § 623A.600 - Petition for adoption, filing, amendment or repeal of regulation; petition for declaratory order or advisory opinion
1. Any interested
person or agency may petition the Board to adopt, file, amend or repeal any
regulation of the Board, by letter addressed to the Executive Director of the
Board. Relevant data, views and arguments must accompany such a petition. The
Board will consider a petition filed pursuant to this subsection at its next
regularly scheduled Board meeting. The Board will, not later than 30 days after
the meeting:
(a) Initiate the rule-making
process; or
(b) Deny the petition
in writing, stating its reasons for the denial.
2. Any interested person or agency may
petition the Board for a declaratory order or an advisory opinion regarding the
applicability of any statutory provision or regulation or decision of the
Board. The Board will consider a petition for a declaratory order or an
advisory opinion filed pursuant to this subsection at its next regularly
scheduled Board meeting. The Board will, not later than 30 days after the date
of the meeting:
(a) Issue a declaratory order
or an advisory opinion; or
(b) Deny
the petition for an order or opinion in writing stating the reasons therefor.
